LPPSA Lawyer for Civil Servants: Role, Appointment and What the Firm Handles

If you are a civil servant financing a home through LPPSA, you must appoint a lawyer to prepare the LPPSA financing and security documents. LPPSA's current circular requires applicants to appoint a lawyer from a registered law firm, and LPPSA's guidelines say this lawyer handles the stakeholder and property-charge side of the financing. You are free to choose any lawyer for the Sale and Purchase Agreement (SPA), but the financing documents must go to a firm that can act on LPPSA matters. This guide explains what the LPPSA lawyer does, how the appointment works, what the fees cover and what to prepare before you engage a firm.

LPPSA (Lembaga Pembiayaan Perumahan Sektor Awam, the Public Sector Home Financing Board) currently operates under Pekeliling Pembiayaan Perumahan LPPSA Bil. 1/2026 and its accompanying guidelines, in force since 1 January 2026.

Who can apply for LPPSA financing?

LPPSA financing is for the groups listed in the circular, which include members of the public service, the police and the armed forces, employees of statutory bodies and local authorities, and certain office-holders, subject to each group's conditions.

The basic conditions include being a Malaysian citizen and, for public servants and statutory body or local authority staff, being a permanent officer who is confirmed in service with at least one year of service. You must not be bankrupt, a judgment debtor, financially incapable, or facing disciplinary action with a view to dismissal. Contract staff are not eligible, according to LPPSA's FAQ.

LPPSA approves the lowest of the property price, the JPPH (Valuation and Property Services Department) valuation, the amount you apply for and your maximum eligibility. On 4 September 2026 LPPSA announced improved eligibility limits of up to RM1 million based on repayment capacity; check LPPSA's current notice for the detailed terms.

The profit rate under the circular is 4% a year on a reducing balance for conventional financing (SPPSA). For Islamic financing (SPPSAi) the rate is 7% a year, with an effective 4% through muqasah/ibra' (rebate).

What does an LPPSA lawyer do?

The lawyer you appoint for LPPSA:

  • prepares the LPPSA financing agreement;

  • prepares the security document: a charge where the individual or strata title has been issued, or an assignment of your rights where it has not;

  • gives LPPSA a Letter of Undertaking in LPPSA's format;

  • submits the Letter of Offer, the Memorandum of Acceptance and the completed charge documents to LPPSA;

  • submits the charge form and related documents within 30 days of receiving LPPSA's letter appointing the lawyer;

  • presents and registers the charge at the land office, obtains the stamp duty exemption endorsement for the LPPSA financing documents, and returns the original title and duplicate charge to LPPSA within one month of LPPSA's letter; and

  • acts as stakeholder in the release of the financing to the seller, developer or existing financier, in line with LPPSA's conditions.

In a subsale purchase, the lawyer also coordinates with the seller's lawyer and the seller's bank so that the seller's loan is redeemed and the title is clear for LPPSA's charge.

Registered lawyer: what it means

LPPSA's circular requires the lawyer to come from a law firm registered with the Malaysian Bar (Peninsular Malaysia), the Sabah Law Society or the Advocates Association of Sarawak. LPPSA also maintains a registered-lawyer portal listing firms by state, and states that each registered firm (and each branch) must subscribe to the Juris Credit module in LPPSA's lawyer management system; a firm that is not subscribed is not listed and cannot handle LPPSA customers' financing documents.

Before you name a firm, check that it appears on LPPSA's official registered-lawyer listing for the relevant state.

SPA lawyer vs LPPSA lawyer

These are two different roles:

  • SPA lawyer: acts on the purchase between you and the seller or developer. LPPSA's guidelines say you are free to choose any lawyer for the SPA.

  • LPPSA lawyer: prepares the financing and security documents for LPPSA.

Many buyers appoint the same firm for both, which keeps the SPA timetable and the LPPSA documents aligned. That is a choice, not a requirement, and it is subject to the firm's professional and conflict rules.

How to appoint an LPPSA lawyer

  1. Choose the firm before you apply. Check that it is on LPPSA's registered-lawyer listing for your state.

  2. Ask for a legal-fee quotation in LPPSA's template if you want the financing-document fees included in your financing. LPPSA's FAQ states that the quotation is submitted with the application.

  3. Name the firm in your LPPSA application as your lawyer for the financing documents.

  4. After approval, LPPSA issues the Letter of Offer and an appointment letter to the lawyer. Accept the offer within the time stated in it and give the signed Letter of Offer and Memorandum of Acceptance to your lawyer promptly.

  5. Sign the financing and security documents when the lawyer is ready, and provide any documents the lawyer asks for.

Can you change your LPPSA lawyer?

Only in limited cases. LPPSA's guidelines allow a change of lawyer where the firm's registration as an LPPSA registered lawyer has been terminated, the firm has stopped practising, or the firm's partnership has been dissolved. A new Letter of Undertaking in LPPSA's format is needed if the lawyer or the firm's name changes.

This is why it pays to choose a firm you are comfortable with at the application stage.

LPPSA legal fees: who pays and what is financed

You pay the legal fees. LPPSA's circular states that legal costs are borne by the customer. However, the legal fees for preparing the financing agreement fall within the scope of LPPSA financing, so you can choose to have them financed and repay them with your instalments.

Only the financing-document fees can be financed. LPPSA's FAQ states that SPA fees, transfer fees, caveat costs, stamp duty and statutory declaration costs are not financed. If the actual financing-document fees turn out higher than the approved estimate, you pay the difference first; any overpayment is refunded after the financing is completed.

Fees follow the statutory scale. In Peninsular Malaysia, legal fees for loan and financing documents follow the SRO 2023 scale, calculated on the financing amount, plus service tax and disbursements. For the detailed calculation, see our guide to housing loan and loan agreement legal fees.

No stamp duty on the LPPSA financing documents. LPPSA's financing documents are exempt from stamp duty; the lawyer obtains the exemption endorsement from the stamp office. Stamp duty on the SPA side, such as on the transfer, is separate and paid by you.

From approval to release: the sequence

  1. LPPSA approves the application and issues the Letter of Offer.

  2. You accept, and the signed Letter of Offer and Memorandum of Acceptance go to your lawyer.

  3. The lawyer prepares the financing agreement and the charge or assignment documents, and gives LPPSA the Letter of Undertaking.

  4. The lawyer submits the charge form and related documents to LPPSA within 30 days of the appointment letter, registers the charge and returns the original title and duplicate charge to LPPSA.

  5. LPPSA releases the financing to the seller, developer or financier once its conditions are met, including payment of any difference between the price and the approved amount.

What to prepare before you contact a lawyer

  • your LPPSA application status (or approval and Letter of Offer if issued);

  • the booking form, SPA or draft SPA (since 5 February 2024 LPPSA has not accepted an Offer to Purchase or sales proforma for its main purchase financing types);

  • a copy of the title or the property's title details;

  • the seller's or developer's details, and whether the seller still has a loan; and

  • whether you are applying alone or jointly.
