What we help with

  • Buying a property: subsale purchases, the Sale and Purchase Agreement (SPA), title and bankruptcy searches, stamping and registering the transfer.
  • Selling a property: the seller's side of the SPA, redeeming an existing bank loan and discharging the charge on the title.
  • Transfers within the family: transfers between spouses, parents and children (love and affection), including stamp duty and state consent where needed.
  • Financing documents: bank loan and LPPSA financing documents. The firm is on the LPPSA panel and on bank panels.
  • Inherited property: property still registered in the name of someone who has passed away, and transferring it to the beneficiaries.
  • Title issues: lost titles, caveats, discharge of charge and transfers that were never perfected.

Why the area matters

Property law is national, but the process is local. Each title is registered at a particular land office, assessment tax is paid to the local council, and each state sets its own rules on Malay reservation land, restrictions in interest and consent to transfer. Each area page below explains which land office and council apply, and what to check before you pay a deposit or sign.

How it works

Choose your area and tell us briefly what you want to do. We look at the type of matter, what needs to be checked and the next steps, and during office hours we reply within 30 minutes. Many matters can start with copies of your documents. Where a document must be signed before a qualified witness, we will tell you when and how it can be arranged, at our Kuala Lumpur or Johor Bahru office or where you are.

Legal fees for sale and purchase agreements and loan documents follow the scale under the Solicitors' Remuneration Order. We confirm the scope first, so the quotation reflects your actual matter.

Frequently asked questions

Do I need a property lawyer located near my property?
Not necessarily. What matters is that searches and registration are done at the correct land office for your property. Our team works from Kuala Lumpur and Johor Bahru and handles matters across the areas listed on this page.
What does a property lawyer do when I buy a house?
A property lawyer checks the title and the seller's position, prepares or reviews the SPA, handles stamping and the transfer, works with your bank on the loan documents and registers the transfer at the land office.
How much does a property lawyer cost in Malaysia?
For sale and purchase agreements and loan documents, legal fees follow the scale under the Solicitors' Remuneration Order, plus disbursements and service tax. Stamp duty is a separate government charge. We give a quotation once we know the type of matter and the property value.
Can I transfer my house to my child or spouse?
Yes. A transfer by way of love and affection is common. Stamp duty relief may apply between certain family members, subject to the current rules, and some titles need state consent first. We check this before the transfer is prepared.
Do you handle LPPSA financing?
Yes. ASCOLAW is on the LPPSA panel and prepares LPPSA financing documents for civil servants buying or refinancing a home.
