Need a Lawyer's Quotation for an LPPSA Home Purchase? What Information Should You Prepare?

You do not need to wait until every transaction document is complete before asking a lawyer for an LPPSA quotation. If you already know which property you are buying, prepare at least the purchase price, the LPPSA financing amount, the property location and type, the title status, the type of transaction and the basic documents you have, such as the booking form, a draft SPA or your LPPSA approval letter.

This information lets the law firm separate the purchase work from the financing documentation, identify whether the security will be a charge or an assignment, and estimate the disbursements and any extra work that may be needed.

If you only tell a lawyer, "I want to buy a house using LPPSA. How much is the legal fee?", the firm may not yet have enough to give you a useful quotation. An LPPSA purchase can involve more than one legal scope: the SPA and transfer, the LPPSA financing documentation, a charge or assignment, redemption of the seller's existing loan, state authority or housing authority consent, and other title-specific work. The quickest approach is to send the key facts together at the start.

"A useful quotation is not just one number. It should show the actual scope, whether that is the SPA, the financing or both, so you know what you are paying for," says Akmal Saufi Mohamed Khaled, lawyer and principal of ASCOLAW (Messrs Akmal Saufi & Co).

The minimum information for an LPPSA lawyer's quotation

For an initial assessment, provide these points:

  1. your full name and phone number;

  2. the purchase price of the property;

  3. the LPPSA financing amount you are applying for or have been approved;

  4. the full address of the property, including the state;

  5. the type of transaction, such as a subsale, a purchase from a developer, building a house or refinancing;

  6. the type of property and its title status;

  7. your current status: just booked, SPA not yet signed, application submitted or LPPSA already approved;

  8. whether the seller still has an outstanding loan;

  9. whether you need the lawyer for the SPA, the LPPSA financing documentation, or both; and

  10. key dates, such as the booking date, the deadline for signing the SPA, or any date or condition stated in your approval letter.

If you only have some of this information, send what you have. Depending on the firm's procedure, an initial quotation may be prepared on stated assumptions and then updated or confirmed once searches and the actual documents are received. Mark anything you are unsure of as "not sure" rather than guessing.

1. Purchase price and LPPSA financing amount

State these two figures separately. The purchase price is the price in the booking form or SPA. The financing amount is what you want to apply for, or what LPPSA has approved.

Do not just write "RM500,000 house" without the financing amount. Fees for the purchase work are generally linked to the price or value concerned, while fees for the financing documentation are linked to the financing amount and the type of security document to be prepared. For transactions in Peninsular Malaysia, the Solicitors' Remuneration Order 2023 governs the fee structure for the conveyancing and financing work it covers.

Knowing both figures also lets the lawyer see early whether there may be a shortfall that should be discussed before the SPA and financing documents progress too far. Do not alter or inflate the SPA price to match a financing amount you want. The SPA must reflect the genuine price agreed between the parties, and the financing must follow LPPSA's actual requirements.

A quotation is not confirmation that LPPSA will approve that amount. Approval and the amount financed are subject to LPPSA's assessment and conditions.

2. Financing type and transaction type

LPPSA has several financing types, including buying a completed house, buying a house under construction, building a house on your own land, buying land to build a house, settling existing financing and renovation.

Say clearly which applies to you:

  • a completed subsale house;

  • a new house from a developer, still under construction;

  • a new house that is already completed;

  • land to build a house on;

  • building on your own land;

  • settling an existing bank loan; or

  • joint financing.

3. Address, state and property type

Give the full address, including the district and state. Registration fees, searches, consent requirements and land office practice can differ by location.

Also say whether the property is:

  • a terrace, bungalow or semi-detached house;

  • an apartment, condominium or other strata property;

  • vacant land;

  • freehold or leasehold, if you know;

  • a Bumiputera lot or Malay Reserve Land, if applicable; or

  • subject to a restriction in interest.

4. Title status: charge or assignment

This is one of the most important details for an LPPSA financing quotation.

If an individual or strata title has been issued and can be registered, the financing security usually involves a charge. If a separate title has not been issued, the matter may involve an assignment and different supporting documents. LPPSA provides separate legal-fee quotation templates for charge and assignment on its supporting forms page.

A title review can also show whether the seller is the registered proprietor, the tenure, any restriction in interest, existing charges and whether consent may be needed. Two houses at the same price can need very different legal work.

To help the firm pick the right category, send one of these if you have it:

  • a copy of the individual or strata title;

  • an official or private search;

  • the earlier SPA or deed of assignment;

  • the developer's letter on the title status; or

  • at least the unit number, project name and developer's name.

Do not guess. Write "title status not sure" if you have no confirmation, and do not delay the enquiry just because one document is missing.

5. Booking form or SPA

If you have signed a booking form, send the full copy, not only the page showing the price. It may state the buyer's and seller's names, the price and deposit, the time for signing the SPA, the financing condition, the agent's details, a list of fittings and what happens if financing is not obtained.

If you have not signed anything yet, tell the firm before you commit. If you have already paid a booking fee or signed a document, tell the lawyer immediately, because deadlines or conditions may already be running.

6. LPPSA approval letter or application information

If LPPSA has approved your financing, attach the full approval letter, including its attachments, and point out any important date or condition in it.

If the application has not been submitted, state your actual position: just checked eligibility, preparing the application, application submitted, waiting for assessment or decision, approval received with conditions, or full approval letter received.

The firm may also ask for details relevant to an LPPSA financing enquiry, such as whether your appointment has been confirmed, your length of service, your latest payslip, your retirement age, your pension or EPF scheme and whether you have used LPPSA financing before. A lawyer's quotation is not LPPSA's eligibility decision. LPPSA decides the financing application under its current rules.

7. Seller, developer and existing financing details

For a subsale house, give:

  • the seller's name;

  • the seller's lawyer, if one has been appointed;

  • whether the seller still has a loan or financing, and with which bank or financier, if known;

  • whether the house is still occupied; and

  • any redemption issue you have been told about.

If the seller's property is still charged, the sale may need a redemption process: the seller's financier has to be paid and the existing security discharged before your ownership and financing security can be completed. That is extra work compared with a property whose loan has been fully settled.

For a purchase from a developer, give the developer's name, the project name and unit number, the developer's lawyer, the developer's SPA or letter of offer, and the construction or handover status.

8. Consents, restrictions and special issues

Mention anything you already know about restrictions in interest, state authority consent, developer consent, a Bumiputera lot or Malay Reserve Land, caveats, an owner who has died, a seller or buyer overseas, joint financing, a purchase between family members, a damaged or lost title, or a change of lawyer after work has started. Requirements differ by state, property category and title conditions, and a quotation prepared before these facts are known may need to be revised.

Tell the firm whether you need SPA work, LPPSA financing work, or both

The legal work for the purchase (SPA and transfer) is not the same as the legal work for the LPPSA financing documentation and security. A firm may handle both, but do not assume every quotation covers both. When asking, say clearly whether you need a quotation for the SPA and purchase, for the LPPSA financing documentation, or for both.

Can financing-documentation legal fees be included in the LPPSA financing?

LPPSA's current checklists ask for a legal-fee quotation where you want eligible financing-documentation legal fees included in the financing amount, subject to LPPSA's rules and approval. The quotation must carry your identifying details and the property details.

This does not mean every legal cost of buying the property is financed by LPPSA. The SPA, the transfer and other transaction costs are separate. Ask the lawyer to show clearly which quotation covers the purchase work and which covers the LPPSA financing documentation, so you know how much cash to prepare yourself.

A simple message you can send when asking for a quotation

You do not need a long explanation. A structured enquiry is enough, for example:

"I am buying a property using LPPSA financing. Purchase price: RM[amount]. Proposed LPPSA financing: RM[amount]. Property: [address, state and type]. It is a [subsale / developer] purchase. Title: [individual / strata / not yet issued / not sure]. Seller's loan: [outstanding / settled / not sure]. My LPPSA status: [not applied / applying / approved]. I need legal work for [the SPA / LPPSA financing / both]. I have attached the documents I have."

What should the quotation tell you?

Do not look only at the final total.

Scope of professional work

Does the quotation cover the SPA and transfer, the LPPSA financing documentation, a charge or assignment, consent for the transfer or charge, redemption coordination, registration, or other work?

Professional fees, service tax and disbursements

The quotation should separate professional fees from service tax, where applicable, and from disbursements such as searches, registration, filing, courier and authority fees.

Assumptions and conditional items

For example, a quotation may assume that an individual title has been issued, that there is no restriction or caveat and that there is only one applicant.

Amounts you pay yourself

If you plan to include the financing-documentation costs in your LPPSA financing, say so at the start.

A quotation is not a guarantee of LPPSA approval

A quotation records the scope, fees, disbursements and assumptions based on the information available and the firm's stated terms. The amount or scope may change where the quotation says it depends on facts not yet confirmed, for example if the price or financing amount changes, a search reveals a restriction, caveat or charge, the title turns out not to be issued, consent or extra documents are needed, the purchase changes from one applicant to two, another party changes the terms, or work outside the original scope is requested.

Before accepting a quotation, ask three questions:

  1. What is included in the scope?

  2. Which items cannot yet be confirmed?

  3. What information could make the quotation change?

This also stops you comparing two quotations with different scopes as if they were the same.

What happens after you send the details to ASCOLAW?

Frequently asked questions

Can I ask for a quotation before my LPPSA financing is approved?

Yes. Say that the financing amount is still an estimate. The quotation may need updating once the approved amount and conditions are known.

I have just paid a booking fee. Is that enough information?

The booking form, the price, the address, the property type and an estimated financing amount are usually enough for an initial review.

Is an SPA quotation the same as an LPPSA financing quotation?

No. The SPA and transfer and the financing documentation are different workstreams, even if the same firm handles or coordinates both.

Can all legal fees be included in my LPPSA financing?

Do not assume so. LPPSA's application documents deal specifically with eligible financing-documentation legal fees. Budget separately for the SPA, transfer and other transaction costs.

How long does it take to get a quotation?

It depends on how complete your details are and how complex the transaction is.
