What Can Delay an LPPSA Home Purchase?

An LPPSA home purchase is usually delayed because one document, condition or party is not ready at the right stage, not simply because "LPPSA is slow". Common bottlenecks include using the wrong financing type or checklist, an incomplete SPA, details that do not match across the application and the SPA, a queried Head of Department confirmation, an unresolved title, consent or restriction issue, a seller's loan that still has to be redeemed, a documentation lawyer who cannot yet process the LPPSA file, incomplete security or registration documents, and disbursement conditions that have not been met.

The quickest way to find the problem is to ask four questions: which stage is the file at, which document is still outstanding, who has to provide it, and what is the date of the next action?

Do not only ask "Has LPPSA approved it yet?" Financing approval and completion of the property transaction are connected, but they are separate workstreams.

"When clients ask me why their file is slow, I always ask back: slow at which stage? Application, documentation or disbursement? The cause, and the person who has to act, is very different at each stage," says Akmal Saufi Mohamed Khaled, lawyer and principal of ASCOLAW (Messrs Akmal Saufi & Co).

First, identify the stage of the transaction

Before looking for the cause, work out where the file actually is:

  • Before the application: the house has been booked, the SPA is being prepared and your documents are being collected.

  • Application review: the application has been submitted but is being queried, assessed or is waiting for documents.

  • After approval: financing has been approved but the legal and security documentation is not complete.

  • Before disbursement: documents have been signed, but a condition, consent, registration or undertaking is still outstanding.

  • Completion: money is being coordinated with the seller, the seller's bank, the developer or another party before the keys or vacant possession are handed over.

"Still processing" is not a useful answer. Each stage has a different person responsible for the next step: the buyer, the Head of Department, the seller, the lawyers, the developer, the valuer, the land office or LPPSA.

Cause 1: the wrong checklist or financing type

LPPSA publishes separate checklists for each financing type. Among them, Type 1 is for buying a completed house or residential parcel and Type 3 is for buying a house or parcel under construction. Other types cover building a house, buying land, settling existing financing and renovation.

Documents that are right for one type are not necessarily enough for another. If the property is described wrongly, for example a developer unit still under construction treated as a completed subsale, the application may need correcting or extra documents. Cause 2: the SPA is not ready or its details are incomplete

A booking form or offer to purchase is not a substitute for the SPA where the application needs one. LPPSA has announced that, since 5 February 2024, a Sales Proforma or Offer to Purchase (OTP) is no longer accepted as a supporting document for Types 1, 3 and 4. An original or draft SPA must be submitted instead.

LPPSA explained that OTP information can be incomplete or inconsistent with the SPA, including title details, parcel details, car park prices and the cost of additional works. These inconsistencies can lead to amendments to the financing offer after approval, which slows the process down.

SPA issues that can trigger a query or correction include:

  • names or identity card numbers that are wrong;

  • a purchase price that does not match the application;

  • incomplete title, parcel or car park details;

  • a seller or developer name that differs from the title documents;

  • the type of transaction not described correctly; or

  • missing pages, schedules or signatures.

Cause 3: applicant or Head of Department documents are queried

Your service, income, deduction and confirmation documents must match the current checklist. Since 1 October 2025, LPPSA has used a Head of Department Confirmation Letter (Surat Pengesahan Ketua Jabatan) in place of the old Head of Department cover letter. LPPSA's notice warned that the details must be completed accurately to avoid the application being queried or rejected, and using the old format after the transition period can also cause a query.

Check the basics:

  • the current template is used;

  • your name, post, appointment date and salary number match;

  • the confirmation is made by an authorised officer;

  • copies of payslips and supporting documents are clear;

  • documents have not expired; and

  • there are no unverified handwritten amendments.

Cause 4: buyer, SPA and application details do not match

Small differences can lead to queries if they affect identity, price, property or the financing structure. For example:

  • a name spelt differently in different documents;

  • an old title number used after the strata title has been issued;

  • an SPA price that is different from the amount in the application;

  • a car park lot listed inconsistently;

  • a joint applicant not stated correctly; or

  • the property type or completion status described inaccurately.

Cause 5: title, searches or restrictions in interest

A transaction can stall even when your documents are complete, if the property position is not clear. Depending on the property and the lawyer's scope, the legal checks may cover:

  • who the registered proprietor is;

  • whether an individual or strata title has been issued;

  • registered charges, caveats or other encumbrances;

  • restrictions in interest;

  • the category of land use and express conditions;

  • relevant arrears or statements; and

  • whether an earlier title matter, such as a perfection of transfer, is still incomplete.

For property in Peninsular Malaysia, transfers and registered charges are governed by the National Land Code 1965. Sabah and Sarawak have their own land laws.

Cause 6: developer property needs the correct eSPA documents

For Type 3 applications involving property built by a developer, LPPSA's notice dated 30 January 2026 sets requirements for the Ministry of Housing and Local Government (KPKT) eSPA.

At application stage, you must submit a draft or copy of the eSPA generated from the HIMS system together with the supporting documents. At documentation stage, the lawyer must submit the complete eSPA set, upload it to Juris Credit and include the result of the KPKT eSPA portal check as confirmation of authenticity.

Cause 7: the LPPSA documentation lawyer cannot yet process the file

LPPSA's registered-lawyer portal states that each branch of an LPPSA registered lawyer must subscribe to the Juris Credit module to handle LPPSA customer financing documentation. A firm that has not subscribed is not listed in LPPSA's LMS system and cannot handle LPPSA customer financing matters.

Delay can happen if:

  • the firm has not been clearly appointed;

  • the branch or lawyer is not listed to handle the documentation;

  • the appointment letter or file details have not been sent;

  • documents have not yet been uploaded to the system; or

  • the buyer assumed the agent, the SPA lawyer and the financing lawyer were the same party without confirming it.

Cause 8: the seller still has a loan or charge

For a subsale home, the seller may still owe money to a bank or to LPPSA. That financing has to be redeemed and the security released in line with the transaction structure.

Delay can come from:

  • a redemption statement that has not been obtained;

  • a redemption sum that has changed, or a statement that has expired;

  • an outstanding balance larger than the money available for redemption;

  • the seller still having to top up the shortfall for redemption;

  • release documents from the seller's financier not yet received;

  • title or security documents still held by the financier; or

  • undertakings or other documents between the parties not yet complete.

Cause 9: LPPSA financing is less than the price or the balance due

If the LPPSA financing is lower than the purchase price or the balance you have to pay, you must provide the difference (wang beza) yourself, according to the transaction structure. LPPSA's FAQ states that the difference must be paid before the lawyer sends the Advice to Release (ATOR). A delay can therefore happen if the amount of the difference has not been worked out, has not been paid, or the required proof of payment is not ready.

Remember too that an eligibility estimate is not a final approval. If the approved amount turns out lower than you expected, deal with the gap before a payment deadline arrives, not when the balance purchase price is already due.

Cause 10: security, stamping or registration documents are incomplete

After approval, the lawyer still has to prepare and complete the financing and security documents. Depending on the property, this can involve:

  • the LPPSA financing documents;

  • a charge on the title, where applicable;

  • a deed of assignment, where the property has no separate title yet;

  • endorsement of the stamp duty exemption for the LPPSA financing documents;

  • any consent required;

  • registration of the transfer and charge, where applicable;

  • solicitors' undertakings; and

  • the documents needed for disbursement.

Signing late, missing signatures or inconsistent particulars that force documents to be re-executed can all add avoidable time.

Cause 11: other parties are slow to act

An LPPSA purchase involves more than the buyer and LPPSA. Other parties may include the seller and the seller's lawyer, the developer, JPPH (the Valuation and Property Services Department) or a valuer, the land office or state land registry (PTG), LHDN (the Inland Revenue Board), the seller's bank, the strata management body and your Head of Department. Delay by one of them can hold up every later step.

The SPA deadline does not stop while LPPSA is processing

For a subsale purchase, the SPA normally sets a contractual completion period. LPPSA processing does not automatically extend it. If the financing work starts late, you may come under pressure as the contractual deadline approaches. Note the SPA deadline and any extension that may be needed as early as possible, and do not assume it will be extended for you.

Does a system disruption mean there is a problem with your file?

Not necessarily. LPPSA sometimes publishes notices about disruptions or temporary closure of online services. A short disruption can explain why an action could not be done on a particular day, but it should not be the general answer for a long delay.

How to trace the bottleneck in one check

Ask your lawyer, or the relevant party, to fill in these five points:

  1. Current stage: application, approval, documentation, registration or disbursement.

  2. Outstanding item: the exact name of the document or condition.

  3. Who must act: buyer, seller, lawyer, bank, developer, land office or LPPSA.

  4. Date requested: when it was first asked for and when it was last followed up.

  5. Next action: what will happen once the item is received.

A useful update looks like this: "The file is at documentation stage. The complete eSPA set and HIMS check result are still needed from the developer. We asked for them on 12 August and will upload them to Juris Credit once received." That is far clearer than "still waiting for LPPSA".

Buyer's checklist if the transaction is already running late

  • Check the financing type and the current checklist.

  • Make sure the draft or signed SPA is complete and matches the application.

  • Confirm that the current Head of Department Confirmation Letter format was used.

  • Ask for a list of all queries and documents still unanswered.

  • Get the names of the SPA lawyer and the LPPSA documentation lawyer.

  • Ask for the status of searches and any consent or restriction issue.

  • Check whether the seller has financing to redeem and the status of the redemption statement.

  • Confirm the financing amount, the deposit and your shortfall.

  • Note the SPA deadline and any extension that may be needed.

  • Follow up by item and by the party responsible, not with a general message to everyone.

What a lawyer can and cannot do

A lawyer can review the SPA, title and transaction documents, identify mismatches, prepare the LPPSA and security documents, liaise with the seller, bank, developer and authorities, coordinate or monitor consents, redemption and registration within the scope of the appointment, explain which conditions are still outstanding and warn you about SPA dates and risks.

A lawyer cannot guarantee approval, force an authority or financier to decide faster, or clear a query without the proper documents.

Can a lawyer guarantee a completion date?

No. A lawyer can manage the legal work and coordination, but steps that depend on third parties and authorities can affect the timing.

Will LPPSA automatically extend my SPA deadline?

Do not assume so. The contractual deadline is governed by the SPA and the other transaction documents, and it has to be managed under those documents.

Why is my LPPSA application still being queried?

Common reasons are an SPA that is incomplete or does not match the application, the wrong checklist for the financing type, or Head of Department and income documents that are not in the current format. Ask for the exact query in writing so it can be answered with the right document.

When should I tell my lawyer about a problem?

As soon as you know about it. Early notice gives more time to find the legal route and coordinate the parties affected.
