Hibah Confirmation After the Donor Dies: What Should the Recipient Do?

When the donor of a hibah dies, the recipient's first step is to gather the documents, witnesses and other evidence of the hibah that is claimed — before the property is treated as part of the ordinary estate and distributed without taking the hibah into account. This article explains what the recipient should do to establish the hibah after the donor's death. It is not a guide to faraid distribution or to an ordinary estate application.

When someone dies, the family may assume that everything in the deceased's name is now estate property (harta pusaka). But if it is said that the deceased made a hibah — a lifetime gift — before death, the first question is whether that hibah actually happened and what evidence exists.

Do not assume the hibah is valid, or invalid

A document, a spoken declaration or a promise does not necessarily settle every issue. At the same time, the fact that the title was never transferred into the recipient's name does not by itself allow anyone to conclude that there was no hibah. The position has to be assessed on the form of the transaction, the property, the evidence and the applicable law.

In broad terms, the Syariah Court will look at the parties, the property, the offer and acceptance (ijab and qabul), whether possession was delivered (qabd) and the evidence supporting each of these. The Department of Syariah Judiciary Malaysia (JKSM) describes hibah as a gift made during the donor's lifetime without anything in return, and notes that a hibah made during the donor's final illness (marad al-maut) is limited to one-third. The timing of the gift can therefore matter.

First steps for the hibah recipient

Gather what you can, as early as you can:

  • the hibah document, declaration or any letter recording the gift

  • ownership documents for the property, such as the title or a land search

  • records of communication with the donor about the gift

  • details of anyone who witnessed the hibah or heard the donor speak about it

  • evidence of use, payments or control of the property after the hibah

  • the death certificate

If an estate process has already started, also keep copies of what has been filed and the details of whoever is handling it.

Why should the evidence be organised early?

After death, the donor can no longer explain their intention or what happened. That makes documents, witnesses and a clear chronology far more important. A lawyer needs to understand not only what is written down, but what the parties actually did before the death: who lived in or used the property, who paid for it, and whether the donor treated it as already given away.

A simple timeline — when the hibah was made, who was present, what happened to the property afterwards and when the donor fell ill or died — is often the most useful document you can prepare.

What about the other heirs?

An objection by other heirs does not automatically end a hibah claim. It usually means the facts and evidence become more important. Avoid dividing, selling or transferring the property on the assumption that the hibah question has already been settled before it has been reviewed.

Hibah and the estate are not the same thing

If the hibah can be proven and is confirmed, the property may follow a different path from ordinary estate distribution. It helps to understand the difference between the two processes:

  • The Syariah Court is where a hibah is confirmed. It also issues the faraid certificate, which identifies the heirs and their shares. According to JKSM, the Syariah Court does not itself make the order distributing the estate.

  • The estate administration and distribution is handled separately — for a small estate (total value not exceeding RM5 million) through the Estate Distribution Office (Pejabat Pembahagian Pusaka) under the Department of Director General of Lands and Mines (JKPTG), with applications also available through the MyLAND portal, and for other estates through the High Court or Amanah Raya Berhad, depending on the case.

Hibah confirmation also does not, by itself, complete every land, financing, registration or authority step. Each step depends on the type of property and the facts of the case. What if an estate application was filed before the hibah was raised?

This happens often: the family starts the estate process first, before anyone realises or mentions that a hibah was made. If this is your situation, inform whoever is handling the estate — the estate distribution office, Amanah Raya Berhad, the administrator's lawyers or the court — about the hibah claim as soon as possible.

Do not let the estate process go on to distribute property that is claimed to be a hibah before its position has been assessed. Correcting a distribution after it has happened is far harder and more expensive than preventing it at the start.

The time each stage takes depends on the state, the court and whether the hibah is disputed.

When should you get a lawyer's help?

Get an early review if there is a family dispute, the property is about to be sold, the estate process has already started, the hibah document is incomplete, or the property is charged to a bank or subject to a restriction. An early review helps identify whether the real issue is the hibah, the estate, the transfer of the property or a combination of these.
