Cost of Hibah Confirmation in the Syariah Court: What Determines the Fees?

•

There is no single fixed cost for hibah confirmation in the Syariah Court. The fees depend on how complete the documents are, whether the donor is still alive, the type of property involved and whether the hibah is disputed. Two claims that are both called "hibah confirmation" can involve very different amounts of work, so a responsible fee estimate has to start with an understanding of the facts.
Quick summary
The cost depends on the completeness of the documents, whether the donor is alive, the type of property and whether the hibah is disputed.
Legal fees are different from court filing fees, search costs and third-party expenses. A quotation should separate them.
A matter that starts without any objection can change in scope if heirs later object.
The cost of confirmation does not necessarily include transferring the house or land after the order. Check the scope of the quotation.
Why is the cost of hibah confirmation not the same for every case?
Hibah confirmation (pengesahan hibah) is a claim in the Syariah Court asking the court to determine that a hibah — a lifetime gift of property — was validly made. How much work that involves varies widely.
A case with clear documents, easily identified property and parties who do not dispute the facts usually calls for a different approach from a case involving incomplete documents, a donor who has died, witnesses who must be traced or heirs who dispute the hibah.
That is why a responsible fee estimate starts with the facts of the case, not just the name of the claim.
What usually affects the legal fees?
1. The state of the hibah documents
The lawyer needs to see what actually exists: the hibah document, any declaration or letter, transfer documents, correspondence, payment records or other material. If the documents are incomplete or inconsistent, more work may be needed to identify what has to be proven.
2. Whether the donor is still alive or has died
If the donor is alive, certain facts may be obtained directly from them. After death, proof may depend more on documents, witnesses and the surrounding circumstances. This can affect the scope of work required.
3. The type and status of the property
A house, land, a share in co-owned property, charged property or property subject to a restriction can each raise different follow-up issues. Confirmation in the Syariah Court also does not necessarily complete every registration or transfer step — work after the order may still be needed with the land office, a financier or the estate process.
4. Whether the hibah is disputed
If there is an objection, the case may require additional pleadings, wider review of documents, witnesses, submissions and more complex trial management. An undisputed case does not necessarily have the same scope as one that is actually contested.
5. The number of parties and witnesses
The more parties who need to be named, contacted or given the opportunity to respond, the more case management is involved. The same applies where several witnesses are needed to prove material facts.
6. The state and the court concerned
Syariah Court procedure is state-specific. The documents, process and official costs that apply must be checked against the state and the court with jurisdiction. Because a confirmation claim is a formal proceeding built on pleadings and evidence, the expected pleading documents in that state also shape the preparation work.
Summary: cost factors and their effect
Factor | Effect on scope of work |
|---|---|
Incomplete or inconsistent documents | More work identifying and verifying what needs to be proven |
Donor has died | Proof relies more on witnesses and documents, not direct evidence from the donor |
Hibah disputed by heirs | Additional pleadings, witnesses and more complex trial management |
Many parties or witnesses involved | More case management and service of documents |
Work needed after the order | Additional scope, separate from the confirmation proceedings themselves |
How long does the process usually take?
The duration depends on the state, the court's caseload and whether the hibah is disputed. State Syariah judiciary departments publish service timelines for procedural steps, such as fixing a mention date after registration or issuing a written order after a decision, but these cover individual steps only. They do not tell you how long a particular case will take from registration to decision, which depends entirely on the facts and on whether there is an objection. Timelines can also differ between states, so check the current position for the court handling your matter.
Are legal fees the same as court fees?
No. In practice, a quotation may contain different categories, such as:
professional fees
filing or court fees
search or document costs
service of documents
travel, where applicable
other third-party expenses
What is and is not included should be stated clearly in the quotation. Do not assume that a single figure described as "the cost of hibah confirmation" covers all the work up to the completion of the property transfer.
What if the case ends up being contested?
This is an important question to ask before appointing a lawyer. Some matters start without any objection but later become disputed. If the scope of work changes significantly, the fee structure may also change, depending on the terms of the engagement.
Before agreeing to a quotation, ask how additional work will be handled if a defence, extra witnesses or a trial become necessary.
Is the cost of transferring the house or land included?
Not necessarily. Obtaining a hibah confirmation order and carrying out the property work afterwards are two layers of work that can be quite different. After confirmation, there may still be land office, financier, consent, estate or registration steps.
The quotation should make clear whether it covers only the confirmation proceedings or also the implementation work after the order. For the land registration side, see our guide on the land title transfer procedure in Malaysia.
What information should you give to get a more accurate quotation?
Prepare at least:
copies of the hibah documents you have
details of the donor and the recipient
whether the donor is still alive
details of the property
the ownership documents available
whether anyone objects to the hibah
the status of any estate process, if one has started
the end result you want to achieve after confirmation
This information helps distinguish a relatively contained confirmation case from one that requires dispute management or wider property implementation.
Should you choose a lawyer on price alone?
Price matters, but a quotation should be compared together with the scope of work. Two different quotations may in fact cover different scopes. Check who will handle the proceedings, what is included, what counts as additional work and whether the steps after the order are included.
As Akmal Saufi Mohamed Khaled, lawyer and principal of ASCOLAW (Messrs Akmal Saufi & Co), explains: "I can't give a single figure before I know the facts of the case — are the documents complete, is there an objection, is the donor still alive or not. A responsible quotation starts with these questions, not with the same number for everyone."

Frequently asked questions
How much does hibah confirmation in the Syariah Court cost?
There is no single fixed figure. The cost depends on how complete the documents are, whether the donor is alive, the type of property and whether the hibah is disputed. Send the details of your case for a suitable quotation.
Are legal fees the same as court fees?
No. A quotation usually separates professional fees, filing or court fees, search costs and other third-party expenses.
Is the cost of transferring the property included in the cost of hibah confirmation?
Not necessarily. Confirmation in the Syariah Court and the property work that follows are two separate layers of work. Check which of them your quotation covers.
What information do I need to give to get an accurate quotation?
The hibah documents you have, details of the donor and recipient, whether the donor is alive or has died, details of the property, and whether there is any objection or an estate process already under way.
