The key difference is usually whether the deceased left a will and whether there is an executor able to prove it. A Grant of Probate authorises the executor named in the will to administer the estate. Letters of Administration (LA) appoint an administrator where there is no effective executor-based probate route — commonly where the deceased died intestate, although other forms of administration can also arise where a will exists but probate cannot be granted to an acting executor.

The correct route should not be chosen from estate value alone. You need to check the will, executor, type and value of assets, applicable estate regime and whether any dispute has arisen.

What is a Grant of Probate?

The Probate and Administration Act 1959 defines "probate" as a grant under the seal of the Court authorising the executor or executors named in it to administer the testator's estate.

Section 3 provides that probate may be granted to an executor appointed by a will. The appointment may be express or implied, and where several executors are appointed the Act addresses how probate may be granted to them.

So, for a straightforward case: valid will + executor able and willing to prove it → assess the Probate route.

Obtaining Probate does not mean every asset is instantly transferred to beneficiaries. It establishes the executor's authority to administer the estate; bank, land, company and other asset-specific steps may still follow.

What are Letters of Administration?

"Administration" under Act 97 refers to letters of administration issued by the Court authorising the named person to administer the deceased's estate according to law.

The common comparison is: no will → assess Letters of Administration.

But that shorthand is not the whole law. Act 97 also recognises forms of administration connected with a will, including situations where an executor fails or cannot take the grant. Therefore, do not assume that the mere existence of a document called a will automatically means an ordinary Grant of Probate can be issued to the person asking to act.

What if there is a will but the executor cannot act?

This is one of the most important reasons not to treat the decision as a simple yes/no checklist.

Act 97 contains provisions dealing with situations such as:

  • an executor dying before taking probate;

  • an executor renouncing the right to representation;

  • an executor failing to proceed after citation; and

  • failure of executors, after which another form of administration may need to be considered.

The result depends on the will and circumstances. A lawyer reviewing the file may need to determine whether another executor can prove, whether renunciation/citation steps are relevant, or whether administration with the will annexed should be considered.

Does the RM5 million threshold decide whether you need Probate or LA?

No — it is part of the estate-jurisdiction analysis, but it is not the only question.

Malaysia's official government portal, updated in March 2026, currently describes small estates as estates not exceeding RM5 million and describes "large estate" High Court cases as including estates exceeding RM5 million or cases where a non-Muslim deceased left a will under the Wills Act 1959. For the High Court route it distinguishes:

  • deceased with a will → application for Probate; and

  • deceased without a will → application for Letters of Administration.

The exact forum still needs to be checked against current law and the facts. Do not decide the route from one number in isolation.

What documents are commonly relevant at the beginning?

The initial set often includes:

  • death certificate;

  • identity documents of the proposed executor/administrator;

  • will, if any;

  • information about beneficiaries/heirs;

  • list of movable and immovable assets;

  • evidence of ownership such as title, bank, investment or share documents; and

  • information about liabilities, charges or disputes.

Malaysia.gov.my lists similar categories for the current large-estate process. Court filing requirements may require further documents, affidavits, oaths, valuations or explanations depending on the type of grant.

Is a lawyer compulsory for every Probate application?

The Rules of Court require a more careful answer than "always".

The Government portal presents the general large-estate process as a High Court filing through originating summons and affidavit by an appointed lawyer. However, Order 71 rule 3 of the Rules of Court 2012 is the personal-application provision. It states that, subject to the rule, a personal applicant may apply for a grant otherwise than by a solicitor. Rule 3 also sets the circumstances in which a personal application may not proceed through that route, including where the application ought to be made by action or the Registrar otherwise directs.

Accordingly, it is too broad to say that a lawyer is legally compulsory for every non-contentious Probate or LA application. Where the estate has document problems, multiple executors, a caveat, foreign assets or a dispute, obtaining legal advice is particularly important.

What happens after either grant is issued?

Whether the grant is Probate or LA, the grant establishes the authority of a personal representative. Administration work can still remain.

Depending on the estate, that may involve:

  1. identifying and collecting assets;

  2. dealing with banks, companies and registries;

  3. paying debts and liabilities that have to be dealt with;

  4. managing or disposing of assets within the representative's lawful powers;

  5. carrying out land or share transmission/transfer steps; and

  6. distributing the remaining estate according to the will or applicable succession law.

Act 97 contains Parts specifically dealing with the powers, rights, duties and obligations of personal representatives and administration of assets.

When should you get a route assessment before filing anything?

Get specific advice early if:

  • you are unsure whether the document is the operative will;

  • the executor has died, renounced or cannot act;

  • there is more than one executor;

  • the original will is missing or damaged;

  • a caveat or objection has been raised;

  • the estate includes foreign assets;

  • the estate contains substantial land, shares or business interests;

  • there are minor beneficiaries or continuing interests; or

  • you are unsure which estate forum has jurisdiction.

These facts can change the form of grant and the evidence required.

Frequently asked questions

Can I apply for Letters of Administration myself without a lawyer?

Order 71 rule 3 provides a route for a personal applicant to apply for a grant otherwise than by a solicitor, subject to the restrictions in that rule. Whether self-filing is sensible depends on the estate. If the application ought to proceed by action, the Registrar directs otherwise, or the estate has complications such as disputes, caveats, executor problems or unusual assets, legal assistance may be important.

What if the executor named in the will has died or cannot act?

The existence of a will does not automatically mean an ordinary Grant of Probate can be issued to whoever wishes to administer the estate. Act 97 addresses situations where an executor dies, renounces or fails to proceed. Depending on the will and circumstances, another executor may be able to prove it or another form of administration, including administration with the will annexed, may need to be considered.

Does the RM5 million threshold decide whether the estate needs Probate or LA?

No. The threshold is relevant to the forum analysis, but the will and executor position remain central. Current government guidance describes High Court routes that include Probate where a non-Muslim deceased left a will and LA where the deceased did not leave a will. The route should not be selected from estate value alone.
