Need a Quotation to Implement a Harta Sepencarian Order? What Documents Should You Send?

To get a quotation for implementing a harta sepencarian (matrimonial property) order, send at least three things: a complete copy of the sealed or certified court order; the title, an official search or full details of the property; and the status of the loan, the bank and the other party's cooperation.
"I can't give a quotation based on a phone call alone. Send me the order and the title first — from there I can tell you exactly what is needed and roughly what it will cost," says Akmal Saufi Mohamed Khaled, lawyer and principal of ASCOLAW (Messrs Akmal Saufi & Co).
If you have them, also attach the sale and purchase agreement (SPA), Deed of Assignment, financing statement, redemption statement, any consent, instruments already signed and records of any land office application. These documents let ASCOLAW tell whether the scope is only a transfer and registration, or whether it also involves the bank, refinancing, redemption, consent, a sale, correcting documents or enforcement.

Why the value of the house alone is not enough for a quotation
Two houses of the same value can need very different implementation work. For example, the first house is free of any charge, freehold, and both parties are ready to sign. The second still has a joint financing facility, is leasehold, needs consent, and one party refuses to cooperate. The property value may be relevant to certain fees, stamp duty or particular transactions, but the complexity of the work is decided by the order, the title, the bank, consent, the documents and the parties' cooperation.
ASCOLAW needs to know the outcome the court ordered. Must the house be transferred to one party, sold with the net proceeds divided, redeemed or refinanced, transferred after compensation is paid, kept until a certain date, or enforced through further steps because a party has not complied? The outcome decides who has to be involved and how many workstreams need to be coordinated.

1. The complete court order
Send every page of the order, including the signature page, the court seal and any schedule. Do not send only a photo of one paragraph over WhatsApp if the order has conditions on other pages. This matters because, under the National Land Code, the effect of an order on the land register depends on its actual wording. Section 421A of the National Land Code deals with giving effect to orders of the Syariah Court, and on 29 January 2026 the Department of Director General of Lands and Mines (JKPTG) issued Surat Edaran Bil. 1/2026 on the duty of land registrars and administrators to give effect to orders of the Syariah High Court under that section. If available, also attach the judgment or grounds of judgment, any recorded settlement terms, any correcting or clarifying order, and any later order relating to the property.
2. The title or property details
Attach a copy of the individual or strata title, a recent official search, the original SPA, the Deed of Assignment, developer documents, or a quit rent bill that shows the unit details. If you have no copies, give the full address, project name, lot or parcel number, mukim, district and state, as far as you know them.
3. Owners' names and the share ordered
State the current registered owner's name, whether the house is in one name or joint names, the shares shown on the title, the party who is to receive the house under the order, and whether any compensation has already been paid.
4. Loan, charge and bank details
If the house is still financed, give the bank's name, the names of the borrower and the chargor, the latest loan statement, a redemption statement if you have one, and the status of any refinancing or loan takeover application.
5. Leasehold, restriction in interest and consent
If the title says a transfer or charge needs consent, send a copy of the page showing the restriction in interest, any consent application already made, any approval or rejection letter, and any consent from the bank or a caveator.
6. The other party's level of cooperation
Choose the description that fits best: agrees and is ready to sign; agrees but has not handed over documents; not responding; refuses to sign; cannot be traced; has passed away; or is challenging or appealing the order. If there is a problem, attach the communications, any letter of demand or proof of service.
7. What has been done since the order
Tell ASCOLAW whether a previous lawyer opened a transfer file, whether Form 14A (the National Land Code transfer form) was signed, whether stamp duty was dealt with, whether consent was applied for, whether the bank was contacted, or whether any application was rejected or queried. Attach presentation numbers, receipts and correspondence so the firm does not repeat work that has already been done.
If your documents are incomplete, what should you send first?
Use this order: the court order; the full address and the owner's name; a copy of the title or SPA if you have one; the bank's name and an estimate of the loan balance; a summary of the other party's cooperation; and your phone number and email. Be upfront if the title is held by the bank, the SPA is lost or you have not obtained a search yet.
Never send passwords, TAC codes, PINs or access to your bank account. Full identity documents only need to be sent through a confirmed channel when they are actually needed.
How should you read the quotation?
Do not look only at the final figure. Check whether the quotation separates:
professional fees — the legal work described, part of which is governed by the Solicitors' Remuneration Order 2023 (in force since 15 July 2023 in Peninsular Malaysia);
disbursements — payments to third parties such as searches, registration fees, consent fees and stamping;
stamp duty and taxes — assessed under the Stamp Act 1949 according to the instrument and the transaction, so do not assume the transfer is automatically exempt; and
additional work — refinancing, redemption, consent, a sale or enforcement, if they become necessary.
A clear quotation also states its assumptions and exclusions, so you know what could change the figure later. What happens after you submit the form?
The usual first steps are:
A conflict check is carried out based on the parties' names.
The order and the property are reviewed to identify the basic route.
Any critical documents are requested if the quotation cannot be finalised without them.
The scope and quotation are prepared with their assumptions and exclusions.
You can ask questions and compare the scope.
The engagement starts only after you accept the quotation.

Does a conflict check mean the firm is checking my background?
No. A conflict check is a standard step for law firms to make sure there is no professional conflict of interest — for example, the firm having acted for the other party before. It is not a personal investigation.
If I send documents but do not go ahead, what happens to them?
Information sent for an initial review is used to assess the scope and prepare the quotation. If you have specific concerns about how your data is kept, ask the firm directly about its data retention practice.
