How Much Are the Legal Fees to Implement a Harta Sepencarian Order on a House?

There is no single legal fee figure that fits every case of implementing a harta sepencarian (matrimonial property) order on a house. The actual cost depends on what the order says, the title status, whether the house is still charged to a bank, the form of implementation needed and whether both parties cooperate.
"Clients always ask 'how much'. My honest answer is that I need to read your order and the title search first. Two files involving houses of the same value can have very different costs, depending on whether the house is still charged or whether the former spouse is cooperating," says Akmal Saufi Mohamed Khaled, lawyer and principal of ASCOLAW (Messrs Akmal Saufi & Co).
In a simpler case, the work may centre on reviewing the order and the title, preparing or completing the instrument, stamping and registration. In a more complex case, the cost can also cover a discharge of the charge or refinancing, State Authority consent, additional documents, and court action if the order is unclear or one party refuses to cooperate.

A responsible quotation breaks down at least four components: professional fees, disbursements, stamp duty or taxes, and bank or financing costs where relevant.

That is why a proper quotation should separate at least the professional fees, disbursements or third-party payments, bank or financing costs where relevant, and any additional work outside the original scope. A lawyer needs to see the full order and the property information before giving a figure you can rely on.
A simple rule: do not compare final figures alone. Compare the scope of work, the assumptions, what is excluded and the circumstances that could lead to extra charges.
Why the cost cannot be set by the house's value alone
The value of the house may be relevant to some fees or payments, but it is not the only measure of complexity. Two houses with the same market value can need very different work.
For example, House A has an individual title, no charge, a clear order, and both parties are willing to sign. House B is still charged, needs refinancing, has a restriction in interest, and one party is not cooperating. Even though the values are the same, House B involves more parties, more checks, more documents and more implementation risk.
The Solicitors' Remuneration Order 2023 (SRO 2023), which came into force on 15 July 2023, sets the fee rules for certain non-contentious legal work in Peninsular Malaysia. But implementing a harta sepencarian order is not necessarily an ordinary sale and purchase. The scope can include conveyancing work, financing work and, in some situations, enforcement or further applications to the court. So the amount should be worked out from the work actually needed, not by automatically applying a single percentage or a sale-and-purchase fee calculator. 1. Professional fees for the property implementation work
Professional fees pay for the legal work done. Depending on the case, the scope can include:
reading and interpreting the full order;
checking the title, official search, any restriction in interest, caveat and charge;
advising on the appropriate legal method to give effect to the order;
preparing or reviewing the transfer instrument;
coordinating signatures and documents between the former spouses, the bank and the authorities;
submitting documents for assessment and stamping; and
presenting the documents for registration at the land office or the relevant agency.
2. Disbursements and third-party payments
Disbursements are sums paid on the client's behalf to other parties, or to obtain necessary documents and services. They may include official or private title searches, certified copies of the title or instruments, registration and presentation fees, consent application fees, commissioner for oaths or certified-copy fees, courier charges, and valuation or additional search fees.
Land office rates are not uniform across Malaysia. For example, the official PTG Selangor portal lists specific rates for searches, certified copies and registration based on the type of dealing or the market value. So a quotation should say whether disbursements are included as actual figures, estimates, or a deposit to be adjusted later.
3. Stamp duty and the stamping process
Stamp duty is charged on instruments, not simply because a transaction takes place. The Inland Revenue Board (LHDN / HASiL) explains that the type of instrument, the content of the transaction and the relevant value all affect the assessment. So do not assume every transfer under a harta sepencarian order will get a nominal rate, an exemption or the same treatment. From 1 January 2026, the Stamp Duty Self-Assessment System (STSDS) is being introduced in phases. Transfers of real property that do not involve a valuation by the Valuation and Property Services Department (JPPH) are scheduled for Phase 2, starting 1 January 2027. A quotation should therefore explain whether the duty amount is already known, still subject to assessment, or held only as an estimate.
4. Bank, charge and refinancing costs
If the house still has a loan, the name on the title cannot be looked at separately from the liability to the bank. Implementation may require:
obtaining a balance or redemption statement;
discharging the existing charge;
applying for new financing in the name of the party keeping the house;
preparing new loan and charge documentation;
a bank valuation; or
coordinating the redemption money, the discharge and registration.

5. Fees for court or enforcement action
Implementing the order on the property should be distinguished from the original proceedings to obtain the harta sepencarian order. If the order has been made and everyone cooperates, no new proceedings may be needed.
The scope changes, however, if the order is not clear enough to translate into registrable documents, a party refuses to sign or hand over documents, a new dispute arises about payment, time limits or conditions, the order needs to be clarified or enforced, or further court directions are needed. This court work should not be assumed to be automatically included in the conveyancing fee.
Factors that usually increase the cost
A long or unclear order: wording that does not state the mechanism, dates, payment amounts or who must act.
The house is still charged: the bank has a registered interest and the process cannot ignore the loan balance.
Refinancing is needed: bank approval, valuation, loan documents and registration of a new charge.
A restriction in interest or consent is required: an application to the State Authority or another relevant party.
One party is not cooperating: the case shifts from administrative implementation to an enforcement issue.
The title has not been issued or the name has not been perfected: a different document route applies.
A caveat, encumbrance or search issue: a registration obstacle may need to be cleared first.
Missing documents or mismatched details: certified copies or corrections may be needed.
More than one property or state: each property may carry its own fees.
On the other hand, the scope is usually easier to define when the order is complete, the title is clear, the loan position is known and the parties are willing to provide documents and signatures.
Four things that often get lumped into one "legal fee"
When you ask for a price, make sure you and the firm are talking about the same thing:
The cost of the harta sepencarian proceedings: the work of filing and obtaining the order from the court.
The cost of working out the implementation route: advice on what the order means in practice.
The cost of the property documentation and registration: the instrument, stamping and presentation.
The cost of dealing with non-compliance: letters of demand, further applications or enforcement action.
If you already have an order, do not assume an old quotation for the court proceedings also covers all the work after the order.
Information a lawyer needs to give an accurate quotation
For an initial assessment, have ready a complete and legible copy of the order, the title number, the house address and state, a copy of the title or current ownership document, the registered owners' names and shares, the loan status and bank name, whether an individual or strata title has been issued, any restriction in interest or caveat, the outcome ordered, and whether your former spouse is cooperating.

Can I get a price just by giving the value of the house?
The value alone is not enough. A lawyer also needs to know what the order says, the title status, the loan, any restrictions and how cooperative the parties are. Value can be one input, but not the only one.
Is stamp duty definitely exempt because the transfer happens after a divorce?
Do not assume an exemption applies automatically. Duty is charged according to the instrument and the provisions that apply. The documents, the basis of the transfer and the order must be checked before the duty treatment can be confirmed.
Are land office registration fees the same in every state?
Not necessarily. Rates and requirements can differ by state, type of dealing, value or title. A quotation should use the rates of the authority that deals with your house.
If the house still has a loan, are the bank-related fees included in the implementation fee?
Not necessarily. A discharge of charge, refinancing, valuation and loan documentation can each carry separate fees and payments. Ask for a clear breakdown.
Why does a firm ask for documents before giving a final figure?
Because one sentence in the order or one entry on the title can change the implementation steps. An early review reduces the risk of a quotation that is too low, incomplete or has to be changed sharply later.
