How to Choose a Lawyer When Selling a House in Malaysia

When you sell a house in Malaysia, choose a lawyer who acts only for you as the seller, who holds a valid practising certificate, who regularly handles subsale conveyancing of the kind your sale involves (for example a property still charged to a bank, a strata unit or a leasehold title), and who gives you a written quotation that clearly separates professional fees, disbursements and SST. Clear, prompt communication matters as much as price, because your lawyer is the person who protects the sale proceeds and the title until completion.

Selling a home is one of the largest financial transactions most people make. Before you appoint anyone, it helps to know what to check and which questions to ask. This guide walks you through the points that matter for a seller.

Why the seller needs their own lawyer

In a typical subsale, the buyer and the seller each appoint their own lawyer. The buyer's lawyer protects the buyer; your lawyer protects you. For a seller, that protection usually covers:

  • reviewing the Sale and Purchase Agreement (SPA) so that the price, deposit, completion period and late-payment terms are fair to you;

  • redeeming your existing housing loan with the bank (if the property is still charged) and getting the title released;

  • dealing with any State Authority consent needed for a leasehold or restricted title;

  • making sure the balance purchase price is released to you at the right time and in the right way;

  • assisting with the Real Property Gains Tax (RPGT) forms that must be filed with LHDN (the Inland Revenue Board) after the sale.

1. Make sure the lawyer acts for you, not for the other side

This is the first question to ask. A property agent or the buyer may suggest a lawyer, and that is not unusual. But the lawyer you appoint as seller should be acting for you alone, and should tell you clearly who their client is.

Ask directly:

  • "Will you be acting for me as the seller only?"

  • "Are you also acting for the buyer, the buyer's bank or the agent in this transaction?"

  • "If a conflict arises, how will you handle it?"

A lawyer who acts for you should be comfortable answering these questions in writing in the letter of appointment or engagement letter.

2. Check that the lawyer is entitled to practise

Only an advocate and solicitor with a valid practising certificate may act for you in a property sale. In Peninsular Malaysia you can check a lawyer's name and firm in the Malaysian Bar's online Find A Lawyer directory. Lawyers in Sabah and Sarawak are admitted and regulated separately, so check with the relevant local body if your property is there.

Also check that the firm's name and address match what appears on the quotation and appointment letter.

3. Look for relevant conveyancing experience

Conveyancing has its own procedures, and every sale has its own features. Instead of relying on marketing claims, ask practical questions about the kind of work your sale involves:

  • "How often do you handle subsale transactions where the seller still has a bank loan?"

  • "Have you handled sales of strata units, leasehold land or titles that need State Authority consent?"

  • "Who in the firm will handle my file day to day, and who supervises it?"

The answers will tell you far more than online ratings. A lawyer who explains the steps clearly for your type of property is usually a good sign.

4. Ask for a clear written quotation

Legal fees for property transactions in Peninsular Malaysia are governed by the Solicitors' Remuneration Order 2023 (SRO 2023), and SST at 8% applies to legal fees. Because the professional fee follows a scale, differences between quotations usually come from scope and disbursements, not from the scale itself.

A good quotation should show:

  • the professional fee for each piece of work (for example the sale and the redemption of your loan);

  • disbursements such as searches, registration fees and courier or bank charges;

  • SST;

  • what is not included, such as extra work if a consent application or a title problem arises.

5. Test how the lawyer communicates

A sale usually takes several months and involves the buyer, the buyer's lawyer, one or two banks and sometimes a property agent. You will want a lawyer who:

  • explains legal terms in plain language;

  • replies to questions within a reasonable time;

  • tells you in advance which documents are needed and when;

  • keeps you updated at key stages, such as signing, redemption, payment of the balance price and handover of keys.

Your first call or meeting is a good test. Notice whether your questions are answered clearly and whether the next steps are explained.

6. Understand how your money will be handled

Deposits and sale proceeds should pass through proper channels. Ask how the deposit will be held (commonly by a lawyer as stakeholder), how the balance purchase price will reach you, and how much will go to the bank first to redeem your loan. 7. Choose someone you are comfortable working with

You may be in contact with your lawyer for three months or more. You should feel comfortable asking questions and raising concerns. If something does not feel right at the first meeting, it is better to consider another firm before you sign the SPA.

8. Do not rush the decision

Buyers and agents sometimes push for a quick signing. It is reasonable to take a few days to compare two or three lawyers, provided you do not hold up the transaction unreasonably. Appoint your lawyer before you sign the SPA or accept a booking deposit, so that the terms can be checked while they can still be changed.

Frequently asked questions

Can I use the same lawyer as the buyer?

It is safer for the seller and the buyer to have separate lawyers, because their interests differ on price, deposit, timing and late-payment terms. If a lawyer is asked to act for both sides, ask how any conflict will be managed and get it in writing.

Does the property agent decide which lawyer I use?

No. As the seller, you choose your own lawyer. An agent may recommend a firm, but the decision and the appointment are yours.

When should I appoint a lawyer when selling my house?

Ideally before you sign the SPA or accept a booking deposit. That gives your lawyer time to check the title, your loan position and any consent requirement before you are committed.

Why are two quotations for the same sale different?

Usually because the scope differs. One quotation may include loan redemption, consent work or certain disbursements while another does not. Compare what each quotation covers, not just the total.
